I didn't read every post but very interesting & what a nightmare. Would like "attyedhall" to comment on this. I've never purchased a vehicle on Ebay & doubt I ever will.

First, I do have a law degree, but I do not practice law in any state. This is not legal advice.
In my opinion, the buyer is in the right. He can most likely sue for the difference between what he can buy the car ($60K) and the price to buy a similar vehicle (Around $70K or more?)
However, it will most likely not go to court. If the dealership has anyone with a head on their shoulders they will just give the guy the car at the ebay price.
They have gotten a lot of bad publicity. It hit autoblog.com and the posts have recieved thousands of views (if not hundreds of thousands). I am sure the tv news in town will pick the story up. The dealer probably lost hundreds of thousands of dollars in bad press. :nono::nono::nono::nono::nono::nono::nono::nono:

On a side note...interesting to see that its often 'cheaper' to buy the 'rare' cars outside of CA.
However, I will still take an AZ/CA/NV/NM car before considering any other states. Rust free ! (and hopefully not sun-baked!)

I agree...If they any business sense they will take the lose and move on ...but will they??? that is the big question.....most people leave their sense at the door when walking into car dealerships..don't ask me why..:confused: but i see it everyday how smart, well educated people totally get ripped off when buying a car and dealerships are not used to deal with someone that can go toe to toe with them..I love to go car shopping ...:mrgreen:

its because there is so much bullshit involved in the buying process and the fact that people get into a new car and just go to mush and the sales guys no this ... they are a bunch of slimey bullshitters ... It happened with my Prowler and eventuall I got it down 8K after resurching and showing the dealer the internet prices and so on ...I walked away 7 times from the deal until I called him and asked if he new a reputable transport carrier to get a Kat to Denver from Texas... shit u should have heard him flap those lips about buying his car and not one from TX ,,, I still smile thinking back ... remember I am Jewish lol :biggrin:

pretty interesting read. As i am licensed in Indiana, this is NOT legal advice, but merely my overview of what the likely courses of action might be for the buyer. an attorney in the state of origin (there is actually some legal leeway on what that means for internet purchases) should be able to more thoroughly pursue it. as i see it, Orange is probably right. pursuing this through peer preasure and or newspapers/ebay/ states atty general complaints/ bbb etc., might force the dealer to honor the sale. additionally, many if not most states have a "deceptive practices statute" that usually involves a claim that a seller has engaged in a practice that "if proven" would result in harm to an otherwise good faith purchaser. in this case, if the dealer purposely advertised the car at a price they knowingly would not sell it for, it would seem to fall within that catagory. however, the dealers claim of the listing facts to be a mistake might prevail if that could be proven as well in terms of making the sale voidable, however it may involve nominal damages to the buyer who apparantly has obtained financing. it would seem that looking at past listings from that dealer would go a long way towards seeing if the dealer engaged in listings that were deceptive or if it truly was a mistake. either way, it would seem that the buyer has recourses if they pursue them. my bet is on the buyer if they keep the pressure on...jmo

Nancy: i have purchased several cars on Ebay and generally been very pleased. that being said, the numbers of reported scams have dramatically increased over the past few years and as David said, you have to keep your senses about things. my brother is old school who wont even entertain buying something over the internet. i do understand the sentiment, but as i said, i buy stuff all the time thru e-bay and have generally had good results. my prowler was at a dealer in Atlanta, ( i was in Indiana) and i had it shipped sight unseen to florida. all in all it was a smooth transactio. i recently bought an older corvette from ft lauderdale on ebay as well. Its not all bad out there, but you Do have to keep your wits about you....

Thanks for your reply! My sister and your brother must be related somewhere along the line. She refuses to use the internet for anything. :-? One of my brothers has purchased several vehicles from Ebay and a couple came from Pompano Beach (Ft Lauderdale) but since we lived there I was able to take a look at them prior for him. He never encountered any problems either.
I've driven the M3 sedan and man.....that guy got a hell of a deal on a hell of a nice car.
But, given that the dealer is already getting bad PR, wouldnt they just try harder to get the guy to pay full price? I mean hell, even if they let it go, the PR damage is done...might as well try to go all the way.

There is no definate result yet, although the dealer agreed to cough out the car keys at the ebay bid price of 60k. The just want to negotiate some conditions, but there are no Updates by the OP on what those conditions are. Maybe there never will, because the general assumption is that the are going to ask the buyer to sign a gad order / non-disclosure agreement to silence and bury this case once and forever.
All the internet hell washed over them in just a single (holiday) weekend. If they had really failed to honor the deal it would have got really ugly I bet. Lots of bogus bids with fake ebay accounts, DoSing of their servers, etc. The internet vigilante mob can be really look mean.

I had a former employee rent a 1 bedroom unit at a studio price. I could have refused them, but the mistake was on our side. I ate the difference in rent for a year. It's called business.
