View Full Version : Who knows the real facts on Licensing agreements for products ?

This is a question that i've wondered about for a long time but never asked for the details. Maybe one of you folks know something about this and can shed some light on it for us. There are quite a few of Prowler owners that make great products as a hobby to sell for our Kats. Most are items that DC do not make or ever will make. It seems unfair that they want a fee for things they have no interest in selling themselves. I find some of the best ideas come from the owners themselves and always try to support their efforts. These new innovations help the owners enjoy the manufacturers product more....why discourage them by charging fees ?
What products require permission or licensing agreements to be in place to sell a product ? What are the guidelines ?
Who collects the money for the licensing agreements ? I would think that this money should be paid directly to Chrysler, if so then why are there 3rd parties collecting it for them ?

Jim, I am by no means an expert on this matter. If a product contains or depicts a licensed trademark, then the product requires a license. If a product does not contain a trademark but is covered under patent, it requires a license to produce. The trademark or patent owner can appoint licensed agents to collect for them. The owner then allows the agent to keep a certain portion of the fees it collects. The specifics of what requires a license is really up to the owner from what I have seen.

Thats good info Dave...
Thank god its not a strictly enforced rule, anytime someone has to get a lawyer it gets expensive.
I seem to remember that Dale Beaman was asked to pay a fee.... and soon stopped selling those great sidelights he was making....maybe that had nothing to do with it but it didn't seem to be something that should have been controled...

Not the mean bastards I thought they were...that just proves that you can't believe everything you are told...I was led to believe they were behind every tree with their hand out...

Jim, all over Florida they have the Trademark Police checking out the Swap Shops. Hardly a month goes by you don't hear of some one selling products labeled 'Guchi, or Rolex, Brut, etc. that are "fakes". Some Mfger's take it very serious as it cuts into their legit sales. I have seen fake Thomas Kincaid's in New Orleans and Miami that appear to save you hundreds, but are worthless, Oakley sunglasses were every where, but they wern't real.

That makes great sense when you see people replicating an item to pawn off as the real deal... or spelling "Rolexx" for a knock off.... I agree that they should bust those guys 100 %.....
Its the gray area stuff that I don't see the point.
lining your pocket with money on the pretense that its going to a manufacturer that couldn't care less...isn't that where the term "chump change" came from ?
sounds like the government doesn't it...lol

I take from the letter that Prowltalk could have a line of items to sell to members only that have the likeness or name script on them of the Prowler as long as they are not sold to the general public and for non-profit use?
In other words, we (club members) could have hats or t-shirts with a Prowltalk logo and the Prowler likeness all on there with no worries.

Thats how I read it as well....
interesting thought... not for sale to the general public, but registering only takes 30 seconds....I guess that means that you can't go to an event and sell to just anyone...unless they fill out a registration card as part of the purchase...
here's a good question: how does DC know that the organization isn't making a profit ?....maybe if you cried poor all the time then they wouldn't check up on you..
looks like a lot of loop holes....

It is all about POWER, egos, personal agendas and politics, not $$$ the "owner" is being slighted as you may think.
Selective enforcement further complicates the issue but that is what fuels the political machine.
This is nothing more than a pathetic attempt for control (power)... the associated egos and personal agendas have driven the copyright issue as a clever disguise for what's to come.
Not too far in the future many will be enlightened regarding public domain and amazed as the puzzle is finally completed.
For me owning a Prowler is all about FUN, FUN, FUN... nothing else. Too bad everyone did not embrace this experience to enjoy.

Well, from reading the letter, I interpret it as thus: A product that is made, let us say a muffler called an SSS, that happens to fit on a prowler, makes it sound better, etc. Is an external product that Daimler would have no control over. (likewise on a hardtop). However if someone made a shimmer that uses the exact lettering used and copyrighted from Daimler ... then they might have cause for that. Only because the lettering is copyrighted. But lets face reality ... anyone all over internet sell t-shirts and stuff that say "Prowler" or "Parking for Prowler only" and nobody gonna get bent out of shape on that. It actually Improves the brandname and exposure even those they are copyright infringements.

I can't agree with you more. BUT ... I do hope that some of you out there keep your garage queens with under 10K miles, so that when I'm ready for another Prowler, there will be a nice one for me to take :)
